Judge Dismisses DC Case against President Trump at Jack Smith's Request

"Dismissal without prejudice is also consistent with the Government's understanding that the immunity afforded to a sitting President is temporary, expiring when they leave office," Judge Tanya Chutkan wrote.

Jack Smith on Monday moved to dismiss both federal cases against President Trump as Trump plans to go scorched earth and fire the special counsel's entire team of prosecutors.

Jack Smith moved to dismiss both cases and said due to the nature of the immunity afforded a sitting President, it does not require dismissal with prejudice.

"As a result of the election held on November 5, 2024, the defendant, Donald J. Trump, will be inaugurated as President on January 20, 2025. It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President," Jack Smith wrote...
