The lawsuit, arguing that Colorado doesn't have the authority to pass laws conflicting with federal prohibitions, claims that the state has thereby "created a dangerous gap in the federal drug control system."

"Marijuana flows from this gap into neighboring states," continues the complaint, "undermining Plaintiff States' own marijuana bans, draining their treasuries, and placing stress on their criminal justice systems."

Colorado Attorney General John Suthers, however, believes the charges are "without merit."
