Boston Sued for Refusing to Fly Christian Flag at City Hall Despite Flying LGBT Flag

Camp Constitution is a charitable trust dedicated to promoting "understanding of our Judeo-Christian moral heritage, our American heritage of courage and ingenuity, including the genius of our United States Constitution, and the application of free enterprise" through a variety of discussions, activities, and events.

Last year its director, Harold Shurtleff, wanted to fly a Christian flag with a red cross on a blue background, with white on three sides, at the city hall to commemorate "the civic and social contributions of the Christian community to the City, the Commonwealth of Massachusetts, religious tolerance, the Rule of Law, and the US Constitution."

But the city denied him a permit on the grounds that it "maintains a policy and practice of respectfully refraining from flying non-secular flags on City Hall flagpoles," and said it would consider a request to fly a non-religious flag instead.

"This policy and practice is consistent with well-established First Amendment jurisprudence prohibiting a local government 'respecting an establishment of religion,'" Boston property management commissioner Gregory Rooney told Shurtleff in an email. "This policy and practice is also consistent with City's legal authority to choose how a limited government resource, like the City Hall flagpoles, is used"...
